Babaieva O. Preparatory proceedings in system of stages of criminal trial of Ukraine.

In the dissertation new results in the form of scientific conclusions concerning the characteristic of preparatory proceedings, its legal nature and a functional purpose, a place in system of criminal proceedings, and also the formulation of scientifically reasonable offers directed on improvement of its standard regulation and law-enforcement practice are received. In the course of research genesis of standard regulation of a stage of preparatory proceedings, and also extent of theoretical development of this perspective are characterized; the essence of preparatory proceedings and correlative communications with other stages of criminal trial is opened; tasks and functions of preparatory proceedings in system of criminal proceedings are established; the periodization of preparatory proceedings is proved; the general order of preparatory proceedings and its differentiated orders are characterized: on the basis of agreements; with release of the person from criminal liability; in the simplified order; in special judicial proceedings (in absentia); in a jury. As a result of a research gaps and collisions of legal regulation interfering effective permission of problems of criminal proceedings are revealed. For their elimination offers on their elimination are formulated.
