Essay

In the dissertation paper for the first time in the Ukrainian philosophical and legal discourse a modern philosophical and legal analysis of the institute of juvenile justice was carried out in the context of the European integration of state-building and law-making processes, which made it possible to distinguish its protective function, not only aimed at condemnation, punishment, convictions, etc., but focused on protection the offender, considering that it is a minor. Therefore, it is emphasized on the proper education of the child in the family, instilling values, patriotism and respect for the law, which will undoubtedly correct the deviant behavior of minors in terms of overcoming the propensity to commit offenses. The dissertation argues the necessity of legal regulation of education and education of children as one of the basic characteristics of the juvenile justice institute, which is intended to protect minors from the negative dimension of deviant behavior. This component is a mutually responsible responsibility of the family and the state, without diminishing in this case the primary significance of the parent's influence. Finally, the institution of the family confirms that internal-family relations greatly affect the increase in juvenile delinquency, because stereotypes and the axiology of communication form a model of children's behavior in society, in the future, in the state.
