Kovalchuk S. Administrative and Legal Regulation of Notarial Service in Ukraine

The dissertation presents a new solution to the scientific problem concerning the administrative and legal regulation of notarial activity in Ukraine. The legal nature of the administrative-legal regulation of notarial activity is revealed. The essence of branch-legal (actually notarial-legal) principles of administrative-legal regulation of notarial activity was revealed and disclosed. The concept is formed and the normative provision of the administrative and legal status of the notary is clarified. The forms of administrative activity of public administration in the sphere of regulation of notarial activity in Ukraine are described. The legal nature of the methods of administrative activity of public administration and administrative procedures in the sphere of regulation of notarial activity in Ukraine is disclosed. The effectiveness of the use of positive foreign experience for improving the national legislation in the field of administrative and legal regulation of notarial activities in matters of "electronic notary" (the Baltic states, Italy), extension of the powers of the notary (Lithuania, Poland) and insurance of joint civil liability (Lithuania) have been proved. The conceptual provisions have been improved and specific proposals on improving the legislation in the field of administrative and legal regulation of notarial activities have been formulated.
