Essay

Thesis presents conceptual idea of philosophical and legal qualification of conflict communication in court proceedings. Qualification includes exploring, estimating, neutralizing and codifying of the complex of factors, which constitute causes and conditions of legal conflict and ensure intersubjective changes, dynamics of contest and mitigation of material, social or non-material damage. The work as well looks into ensuring law adherence by citizens, improving legal culture and reducing crime rate, providing personal security and strengthening law and order. The author has defined the grades of efficacy of qualification of conflict communication (QCC) between the parties in court proceedings, which could help monitor the level of professionalism of a judge and his or her communicative competences. These grades include the high, medium, low and abnormal levels of the QCC. The work puts forward factors for evaluating judge’s communicative competences. These factors are seen through the prism of axiological, semiotic and hermeneutic elements, which indicate the level of both state and social control, of ensuring the principles of law and communication as well as the level of securing citizens’ rights and freedoms (principles of equality, freedom, dignity, humanism, justice, responsibility and rule of law).
