Diakin Y. Evidence in criminal proceedings relating to offenses related to the misappropriation of land

The dissertation explores the problems of proves and evidences in criminal proceedings connected to crimes which are related to the misappropriation of land, based on the study of the criminal procedure provisions and law enforcement practice. The genesis, current state of scientific research on the problems of proves and evidences in criminal proceedings on crimes related to the illegal occupation of the land have been established. Their division into four groups on the basis of the subject of encroachment has been made. The peculiarities of proving the circumstances, which are enshrined in Article 91 of the Criminal Procedure Code of Ukraine, together with relevant sources of evidence, are clarified. The peculiarities of entering information in the Unified Register of Pre-trial Investigations and establishing the nature and magnitude of the damage caused by the criminal offense are distinguished. The means of collecting evidence by the prosecution have been identified. Proposals have been formulated and recommendations to improve the relevant provisions of criminal procedural law have been made.
