Moiseev M. Administrative and legal status of the State Bureau of Investigation of Ukraine

The dissertation is devoted to the analysis of the administrative and legal status of the State Bureau of Investigation of Ukraine, as well as to determining the directions of its improvement. The historical aspects of the State Bureau of Investigation formation and its place in the modern law enforcement system of Ukraine are revealed. Three stages of formation of State Bureau of Investigation activities are distinguished. It is concluded that the State Bureau of Investigation, as a law enforcement agency of Ukraine, participates in the implementation of the law enforcement function of the state by preventing, detecting, terminating, investigating and, accordingly, disclosing criminal offenses attributed by the norms of the current criminal procedural legislation to its subsidiarity. The definition of the concept of "administrative and legal regulation of State Bureau of Investigation of Ukraine activities" is formulated and the sources of such regulation are classified according to their hierarchy in the system of national legislation. Particular attention is paid to the concept of "administrative and legal status of the State Bureau of Investigation of Ukraine" and its structure. The peculiarities of authority, organizational structure, legal guarantees and legal responsibility of the State Bureau of Investigation of Ukraine are clarified. The principles of organization and activity of State Bureau of Investigation are revealed, as well as it is proposed to distinguish the principle of interaction of State Bureau of Investigation with other entities. Foreign experience of organization and activity of counteracting and combating high-level and organized crime is summarized. The directions of improvement of the administrative and legal status of the State Bureau of Investigation of Ukraine are determined and accordingly it is proposed to amend the Law of Ukraine “On the State Bureau of Investigation”.
