Lylyk V. Methods of investigation of misuse of budget funds allocated for waste management

In the presented thesis on the basis of studying of norms of national legislation, scientific works, generalization of judicial investigative practice and official statistics the forensic characteristic of misuse of budgetary funds allocated for work with waste is presented. The main elements of such a characteristic are considered: the subject of the attack, the method of committing the crime, the person of the offender and the traces of the crime. The three typical investigative situations arising at the initial stage of the investigation of misuse of budget funds are outlined, strategic, intermediate and tactical tasks for each situation are outlined, as well as the algorithm of the investigator's actions aimed at solving these tasks is proposed. Objective and subjective factors that influence the resolution of investigative situations are considered. Taking into account the general theoretical provisions of forensics about the system of investigative versions, the general and specific standard versions are offered, which can be nominated and verified by the investigator. Forms of the investigator's interaction during the investigation with the operational units of the National Police and other entities are described. Typical investigative situations occurring at the next stage of the investigation are described, basic tactical tasks of the investigator for each of them are outlined, and typical investigative versions are proposed that need to be checked in parallel or with those already advanced at the initial stage. The main procedural forms of the use of special knowledge in the investigation of misuse of budget funds allocated for work with waste are the involvement of a specialist in the review, interrogation, search and appointment of judicial expertise (economic, construction, technical examination of documents and handwriting).
