Korovaiko O. Legal Regime of Data of the State Register of Real Estate

The thesis is a first comprehensive scientific study devoted to the problems of legal regulation of the regime of data contained in the State Register of Real Estate Rights in Ukraine. The paper presents the definitions and characteristics of legal data regimes as a complex legal doctrine, which contains a set of separate legal provisions of the Administrative Law. The definition of the concept is given and the characteristics of the data contained in the State Register of Real Estate Rights in Ukraine are listed. An author’s list of information processing standards has been proposed, as well as in the State Register of Rights to Real Estate and its Encumbrances. A general process of formation of the legal regime of data of the State Register of Real Estate in Ukraine and the world is analyzed. The status of the legal regulation of the register of real estate in Ukraine is considered. The differences between the systems of registration of Real Estate property were identified and analyzed regarding the legal regime of the data which they contain. The administrative and legal status of the State Enterprise «National Information Systems» as an administrator of the State Register of Real Estate Rights is disclosed. The foreign experience of countries of the legal regime of real estate register data was analyzed through the prism of critical analysis and the priorities for the legal implementation of the relevant provisions in our national legislation were determined. Developed on the basis of a study of proposals and recommendations for improving the legal regulation of relations in the field of state registration of rights to real estate and the creation of conditions for the protection of data contained in the State Register of Real Estate. The ways of improvement of the legal regime of data of the State Register of Rights to Real Estate in Ukraine were determined and the corresponding amendments were proposed to the Law of Ukraine «State Registration of Proprietary Rights to Real Property and Their Encumbrance».
