Essay

The dissertation is focused on determining administrative and legal principles of organizational provision and realization of the right to free legal aid by the subjects who are given the professional status of a lawyer. The author has clarified the modern understanding of the constitutionally enshrined human right to free legal aid, specific features of its administrative and legal provision, as well as the grounds, procedure and principles of the realization. The system and types of free legal aid have been defined; the range of subjects for both receiving and providing free primary and secondary legal aid has been analyzed. The place, tasks and functional appointment of the Bar within the mechanism of providing and realizing the right to free legal aid have been characterized. The author has specified the concept and structure of the legal status of a lawyer in the process of providing free secondary legal aid within administrative judicial proceedings, legal guarantees of its activity and specific features of the liability. The positive international experience of legal regulation and organization of advocacy activity in part of providing free legal aid has been generalized; the main priorities of its borrowing into the national administrative legislation have been determined. Suggestions and recommendations aimed at improving the advocacy activity in the aspect of providing free primary and secondary legal aid have been formulated.
