Burlaka I. Administrative and legal principles of interaction between the State Migration Service of Ukraine and law enforcement agencies in the area of combating illegal migration

It has been argued that counteracting illegal migration is a legally established set of measures of economic, legal, informational and political nature, the implementation of which is entrusted to a system of authorized entities and aimed at preventing the illegal activity of groups or individuals, which is reflected in the movement through the State border of Ukraine in breach of the legally established order of departure, entry and transit through the territory of the State. It has been substantiated that SMS of Ukraine, as a subject of combating illegal migration, ranks high among other law enforcement agencies of Ukraine. It has been stated that the subject of combating illegal migration is the owner of special functions, powers and responsibilities according to which it is a party to the legal relations arising from the implementation of measures constituting the content of combating illegal migration. It has been established that the interaction of SMS of Ukraine with law enforcement agencies in the area of counteracting illegal migration is a jointly agreed, normatively established format of activity of the SMS of Ukraine and law enforcement agencies that are actors in counteracting illegal migration, which is expressed in the conduct of joint operations and activities by the indicated actors. It has been argued that the legal basis for the interaction of State Migration Service of Ukraine with law enforcement agencies in the area of combating illegal migration is a separate group of legal acts of the current legislation of Ukraine, which defines the principles, laws, legal possibilities and competencies, as well as the procedure for cooperation between the actors in counteraction to illegal migration. It has been proved that the administrative branch of law has taken the lead in the system of legal bases of interaction of the SMS of Ukraine with law enforcement bodies in the area of combating illegal migration.
