Bychin S. Detective activity in the mechanism of crime prevention

The dissertation is devoted to theoretical generalization and a new solution to the scientific problem, which consists in understanding the essence of preventive detective activity, establishing its place in the crime prevention mechanism with the development of relevant proposals and recommendations aimed at improving legislation and law enforcement practice. The author defines the concept of preventive detective activity as law-enforcement regulated by law, carried out by certain responsible subjects (detectives) in the established form, the functional content and purpose of which is to impede the action of determinants of crime and its manifestations, and counteract specific types of crimes (especially serious; corruption in nature) ), crime prevention in general. Each type of preventive detective activity that currently exists in Ukraine is analyzed. The methodological foundations of the study of detective activity in the mechanism of crime prevention are established. The necessity of using the synergetic method as the most promising is substantiated. The historical development of protective detective activity in Ukraine is investigated. The criminological characteristic of preventive detective activity has been developed, which is carried out according to two groups of criteria: basic (they make it possible to explore the essence of the object under study); additional (give the opportunity to find out the current state of the object, its dependence on the state of development of society, legal and political processes taking place in society). The state of legal support for preventive detective activities in Ukraine is investigated, and ways to improve it are provided. The state and prospects of increasing the effectiveness of the implementation of criminological policies by state and private detectives are analyzed. The international and European standards of detective work are analyzed, the features of the regulatory framework for the preventive activities of detectives according to the legislation of foreign countries are established. Developed proposals for the implementation of international standards and foreign experience in domestic legislation in the field of preventive activities of detectives.
