The dissertation is a complex study of administrative and legal regulation of obligatory insurance of civil liability of owners of land vehicles in Ukraine.
The implementation of the reform and structural restructuring of the national legislation of the state necessitates the further development of the national insurance market as an integral part of the financial market of Ukraine, which helps to create the basis for sustainable economic growth and provides compensation for losses in the event of natural disasters, accidents, catastrophes and other unforeseen events, for the welfare of the population, the activities of economic entities and the state as a whole.
As a leading market economy, the insurance industry is a complex mechanism that sensitively responds to all socio-economic, political and socio-psychological processes taking place in the country. As a result, the current state of development of the insurance market is characterized by complexity and controversy, which is explained by the imperfection of sectoral legislation, low solvency of domestic insurers, manifestations of industry monopoly, insufficient qualification of personnel in insurance companies, a large number of types of compulsory insurance, by insurers and insurers, which testify to the need to improve the mechanism of administrative and legal regulation tion in that area.
The article analyzes the current sectoral legislation and practice of administrative and legal regulation of obligatory insurance of civil liability of owners of land vehicles, examines the genesis of administrative and legal regulation of obligatory insurance of civil liability of owners of land vehicles, clarifies and analyzes the legal provision of insurance activities. The objective and subjective factors that influence the effectiveness of the administrative and legal regulation of the obligatory civil liability insurance of the owners of land vehicles are investigated, the directions of increasing the efficiency of the regulatory mechanism through the improvement of its legal and organizational bases are determined. The theoretical and practical problems of determining the administrative and legal status of the Motor (Transport) Insurance Bureau of Ukraine, which ensures the formation of competition policy in the country, are clarified. The etymology of the concept of legal status is investigated in the work, its understanding in science and practice is generalized. The concept, structure of the administrative and legal status of the Motor (Transport) Insurance Bureau of Ukraine and its structural subdivisions, their place in the system of state authorities, the system of functions and administrative and legal powers have been determined. The basic powers of the Motor (Transport) Insurance Bureau of Ukraine are characterized, depending on the purpose and functions they are divided into the following: organizational and regulatory; control; law enforcement. The practice of legal regulation and implementation of the elements of the administrative-legal status of the Motor (Transport) Insurance Bureau of Ukraine is analyzed. The main forms of interaction of the Motor (Transport) Insurance Bureau of Ukraine with other state and local self-government bodies are highlighted. The proposals on optimization of the administrative and legal status of the Motor (Transport) Insurance Bureau of Ukraine by amending the current legislation are formulated.
