In the dissertation on the basis of the analysis and generalization of the theory of administrative and maritime law, scientific views, provisions of the current international and national legislation scientific provisions are developed and the decision of a scientific problem concerning the administrative-legal status of the captain of the sea vessel is resulted. The administrative and legal status of the captain of a sea vessel is determined. The analysis and generalization of the international norms of the law concerning regulation of activity of the captain of the sea vessel is carried out. Administrative and legal legislation regulating the activities of the captain of a seagoing vessel in Ukraine is disclosed. The order of acquisition of legal personality of the captain of the sea vessel is defined. The limits of the administrative duties of the captain of a seagoing vessel have been clarified. The administrative rights of the captain of a seagoing vessel are determined. Factors of administrative and legal protection of the captain of a sea vessel are determined. The essential understanding of administrative and legal protection of the captain of the sea vessel as the citizen of Ukraine who carries out management of the vessel under the flag of the foreign state is formed. A comparative characterization of the foreign experience of maritime states in regulating the administrative and legal status of the captain of a seagoing vessel is made. The administrative and legal status of the captain of a seagoing ship in Ukraine has been improved in order to increase the efficiency and ensure higher safety of seagoing navigation.
