Haievyi V. Legal regulation of compensation of moral and economic responsibility, socio-economic labor relations.

The dissertation is devoted to the complex and thorough analysis of the problems of legal regulation of compensation for moral harm caused to the subjects of labor relations. The article deals with the essence of legal regulation of compensation for moral harm caused to the subjects of labor relations, analyzes the historical development of the institute of moral harm, reveals the concept and grounds for compensation of moral harm in labor law, establishes forms, methods and means of protection of the right to moral harm caused in labor relations. Research was conducted on the conditions of liability for non-pecuniary damage, the methodology for assessing the amount of non-pecuniary damage was determined, the procedure, forms and types of non-pecuniary damage were identified. The lawsuit was identified as a means of exercising the right to non-pecuniary damage, and the case-law of national courts on litigation on compensation for non-pecuniary damage caused by a violation of labor rights and the peculiarity of the enforcement of the court’s decision in respect of non-pecuniary damage were considered and analyzed.
