Murykhin S. Punishment for environmental crimes in Ukraine

On the basis of the analysis of official statistical information on the state of environmental pollution in Ukraine, it is determined the feasibility of carrying out sociological and criminological justification for the application of measures of responsibility for environmental crimes and finding the optimal effective system of punishments for their commission. The average growth rate of environmental crimes is found to be 1.07, which is determined by the geometric mean formula. It is concluded that from the absolute number of registered (recorded) crimes the percentage of environmental crimes is relatively insignificant, which is justified by a number of reasons: the lack of an optimal model of public administration for the implementation of state and regional environmental policies of Ukraine; low efficiency of activity of the state control and supervision bodies of the nature users; imperfection of the mechanism of legal responsibility for violation of the standards of ecological safety and rational use of nature.
