Maidanevych H. Administrative responsibility for the illegal use of natural resources

The dissertation presents the solution of the scientific problem of administrative liability for illegal use of natural resources and offers a number of conclusions, suggestions and recommendations. The classification of administrative offenses into offenses in the field of: land protection; subsoil protection; water protection and use of water resources; protection and use of forests; protection of atmospheric air; protection and use of flora and fauna; protection of fish resources; limits and standards for the use of natural resources. The characteristic of subjects of administrative responsibility for violation of the legislation in the field of illegal use of natural resources is given. It is established that the Code of Ukraine on Administrative Offenses contains two types of offenses in the field of use and protection of natural resources, the subjects of which are natural persons-entrepreneurs. The legal nature of the liability of legal entities that may commit various illegal acts that encroach on public relations in the field of use and protection of natural resources is revealed. The opinion on the need to adopt a Code of Administrative Liability is supported. A study of normative legal acts of foreign legislation, which provides for administrative liability of legal entities. The conclusion is made on the need to improve the administrative-tort legislation, which provides for the adoption of a new codified act, which is able to regulate the relationship of administrative liability of legal entities.
