Holodnyk Y. Administrative and Legal Bases of Functioning of the Sphere of Housing and Communal Services in Ukraine

The article focuses on the essence of housing and communal services as an object of administrative and legal regulation. The author defines the concept of «administrative and legal basis for the functioning of housing and communal services in Ukraine» which refers to the set of characteristics of housing and communal services, which require regulation through administrative and legal means of influence, is set out in the rules of administrative law. It is proved that the content of the concept of «right to housing» covers the organizational and legal principles of activity, which are provided by the rules of public and private law, in violation of which, provides for legal liability and justified the need to grant the right to draw up reports on administrative offenses and the right to make decisions on offenses in the sphere of housing and communal services to officials of local self-government bodies, communal enterprises and the state housing and communal inspection. Classified legal acts in the field of housing and communal services, by dividing them into acts regulating relations in the field: reform and development of housing and communal services; administrative and legal status of public administration entities; legal regulation in the field of housing; legal regulation in the field of public utilities; legal regulation in the sphere of settlements improvement; legal regulation in the field of consumer services and legal responsibility. The foreign experience of regulation of the sphere of housing and communal services and the possibility of its use in Ukraine are investigated. The system of subjects of administrative and legal regulation in the sphere of housing and communal services is analyzed. Considering the priority of citizens' rights, considerable attention is paid to improving the most important public utilities procedures. The issue of administrative responsibility in the sphere of housing and communal services is covered. On this basis, proposals and recommendations on improvement of the current legislation of Ukraine in housing and communal services are formulated and substantiated.
