Essay

The work substantiated directions of harmonization of the domestic legislation with european standards of justice on the basis of balancing private and public interests and ensuring the rule of law. Disclosed the essence and value of legal positions and case law practice of the European court of human rights as sources of criminal procedural law of Ukraine. It summarized the content and dynamics of the ECHR and the Supreme Court of Ukraine in criminal proceedings. Based on the system approach, a theoretical concept of legislative consolidation and the ratio of legal conclusions and case practice of the Supreme Court in the system of procedural law sources was developed. The theoretical justification of the provisions on optimizing criminal proceedings in Ukraine is improved through a wide use of case law.
