Avramenko O. Evidence and proof in the administrative proceedings of Ukraine in terms of reforming the justice system

The thesis is devoted to the complex research of evidence and proof in the administrative justice of Ukraine in the conditions of reforming the justice system. According to the results of the study, a number of conclusions, proposals and recommendations proposed by the applicant personally have been formulated. The main periods of formation and further development of administrative justice in Ukraine in the context of reforming the justice system have been highlighted. The concept, classification and model/construction of evidence in administrative proceedings have been defined. The concepts, features, structure and main stages of proving in administrative proceedings have been defined. The peculiarity of the criteria of affiliation and admissibility of evidence is revealed. The peculiarities of the means of proof in administrative proceedings have been determined, highlighting their features. The legal nature of the procedural institution of claiming and providing evidence in administrative proceedings has been clarified. The concept, feature, stages of research and evaluation of evidence in administrative proceedings have been defined. The foreign legal experience of providing evidence and proof is generalized and the directions of its implementation in the legislation of Ukraine have been determined. Ways to improve the procedure for providing evidence and proof in administrative proceedings have been proposed.
