The thesis for a candidate’s degree by the specialty 12.00.07 «Аdministrative law and procedure; financial law; informational law». – Scientific Institute of Public Law, Kyiv, 2020. The author of the dissertation has provided theoretical generalization and a new solution to the scientific problem, which is to determine the nature and specific features of free secondary legal aid within administrative proceedings of Ukraine, tendencies and perspectives for building a new model of secondary legal aid by lawyers within administrative proceedings, taking into account the European vector of Ukraine’s development. The concept and essence of free legal aid in Ukraine, its system and types have been defined. The bases of granting and normative-legal regulation for providing and realizing free secondary legal aid in Ukraine have been formulated. The system of subjects of providing free secondary legal aid has been outlined and the role and place of advocacy among them have been defined. The author has formulated the concept and has outlined the types of subjects of the right to receive free secondary legal aid. The concept and content of administrative procedural legal personality of a lawyer as a subject of providing free secondary legal aid within administrative proceedings have been determined. Specific features of the lawyer’s implementation of administrative procedural legal personality as a subject of free secondary legal aid within administrative proceedings have been clarified. The grounds for the lawyer’s liability as a subject of free secondary legal aid within administrative proceedings of Ukraine have been revealed. The European experience of regulating the right of a person to free secondary legal aid and the possibility of its adaptation in Ukraine has been studied. The author has formulated propositions and recommendations aimed at improving administrative and legal, organizational provision for the realization of the right of a person by a lawyer to free secondary legal aid within administrative proceedings of Ukraine.
