Keleberda V. Stages in the administrative proceedings of Ukraine

In the dissertation on the basis of generalization of conceptual bases, normative sources and practice of activity of administrative courts the maintenance and procedural features of stages of administrative judicial proceedings of Ukraine are comprehensively analyzed, interrelations between them are established, offers and recommendations concerning normative improvement of administrative-procedural legislation are formed. The concept and classification of stages in the administrative proceedings of Ukraine is formed. The legal nature is revealed and the principles of stages in the administrative process are generalized. The administrative-procedural nature and procedures of the initial stages of administrative proceedings of Ukraine are revealed. The legal nature of consideration of the case on the merits as the main stage of administrative proceedings in Ukraine has been clarified. The peculiarities of appellate proceedings in the administrative proceedings of Ukraine are revealed. The legal nature of the cassation review of court decisions of administrative courts in Ukraine has been clarified. The peculiarities of reviewing court decisions based on newly discovered or exceptional circumstances in Ukraine have been clarified. It has been hypothesized that the proceedings before the European Court of Human Rights are an optional emergency stage of administrative proceedings. Execution of court decisions in administrative cases as a stage of administrative proceedings of Ukraine is characterized. A comparative characterization of the stages of administrative proceedings in some EU member states has been made. Proposals aimed at improving the directions and legislation regarding the stages in the administrative proceedings of Ukraine have been developed.
