Ablov Y. Administrative proceedings in cases related to the passage of public service in Ukraine

In the dissertation on the basis of the systematic analysis of norms of the legislation, positions of scientists-lawyers and practice of activity of administrative courts the theoretical and legal bases and features of administrative proceedings in cases connected with passing of public service in Ukraine are defined, sectoral legislation on the consideration and resolution of administrative cases related to the public service. The essence and signs of a public service dispute as a legal one are revealed. It is determined that administrative cases related to public service in Ukraine are, in essence, complex public service disputes between an employee and an employer over the implementation of public service. The principles of administrative proceedings in cases related to public service in Ukraine are disclosed as fundamental general and special principles of procedural conduct of participants in court proceedings for the consideration and resolution of public service disputes. The procedural status of the parties in cases related to public service in Ukraine is determined, the stages of administrative proceedings in such cases are formed, the peculiarities of proving in cases of this category are revealed, the comparative characteristics of foreign experience of administrative proceedings in the analyzed legal category are formed. to increase the efficiency of administrative proceedings in cases related to public service in Ukraine.
