Sherstiuk H. Protection of civil rights of individuals in administrative proceedings in Ukraine

The thesis focuses on the comprehensive analysis of the content and features of the protection of civil rights of individuals in the administrative proceedings of Ukraine. The stages of formation and development of administrative justice have been generalized and the concept, purpose, content and current state of administrative justice in Ukraine have been characterized. Civil rights, which are protected by administrative courts, have been classified, and their essence has been revealed. The thesis also defines the concept, content, features, functions and types of procedural discretion of the administrative court. The rules for enforcement of an administrative lawsuit have been clarified. The concept, legal nature, role has been disclosed and the classification of an administrative lawsuit in the protection of the civil rights of individuals is proposed; the specifics, subject matter, normative regulation and other aspects of administrative and legal regulation of a lawsuit for appeal, forcing to fulfill an obligation, a general lawsuit for the performance of an obligation, a lawsuit for recognition, challenging normative acts, recognition of the unlawfulness of an administrative act and a counter-administrative lawsuit have been clarified. It has been characterized the system of decisions of administrative courts and it is clarified their role in the protection of civil rights of individuals.
