In the dissertation new results concerning the characteristic of change of a legal position of the prosecutor in court of the first instance, its legal nature and versions, places in structure of procedural activity of the prosecutor in court of the first instance, and also a formulation of scientifically reasonable offers directed on improvement of its standard regulation and law-enforcement practice are received. As a result of research the concept and components of a legal position of the prosecutor of court are defined, formulated concept of change of a legal position of the prosecutor, her versions and differentiation with adjacent categories are defined; the factors influencing change of a legal position of the prosecutor in court of the first instance are defined; features of realization of the general beginnings of criminal proceedings are established at change of a legal position of the prosecutor in court of the first instance; the procedural order of change is characterized by the prosecutor of public charge, promotion of additional charge and refusal of maintenance of public charge; legal consequences of change of a legal position of the prosecutor for the prosecutor, court and participants of judicial production are established; scientifically reasonable offers directed on improvement of standard model of change by the prosecutor of a legal position in court are formulated.
