Buravlov S. Administrative and Legal Framework for Activities of Commercial Courts in Ukraine

The thesis provides a solution to a scientific problem of identifying and describing the administrative and legal framework for activities of commercial courts in Ukraine, as well as the formulation of concrete initiatives to improve them. The thesis is the first comprehensive study within the framework of administrative science aimed at revealing the categorical and conceptual, as well as informative and block structure of the administrative and legal framework for the activity of commercial courts in Ukraine. The results of the analysis enable to make the author’s original scientific statements and conclusions. A classifying and conceptual structure of scientific perspective on the concept ‘activities of commercial courts of Ukraine’ is formed and the essence of its administrative and legal framework for proper realization is defined. The impact of reforms concerning the sustainable development of the State on the activities of Ukraine’s commercial courts is highlighted. The characteristics of the administrative and legal framework for organizational support for commercial courts’ activities in Ukraine are disclosed, as well as the peculiarities of the judicial and extrajudicial activities of the subjects under analysis are distinguished. The study reviews positive experience of some of EU Member States with regard to organization and performance of judicial institution of commercial jurisdiction, as well as reveals factors with negative impact on commercial courts’ activities in Ukraine that enables to make concrete proposals for their elimination.
