In the thesis an integrated study of an implementation mechanism by the investigating magistrate of constitutional principles of criminal proceedings during pre-trial investigation has been conducted. The origin and development of the legal status of an investigating magistrate as a guarantee of the implementation of the constitutional principles of criminal proceedings have been studied. A comparative legal analysis of the court's implementation of the constitutional principles of criminal proceedings at the pre-trial stages under the legislation of foreign countries has been undertaken.
