Pavchuk S. Administrative Procedures in the Prosecution Authorities of Ukraine: Issues of Administrative and Legal Regulation

The thesis deals with a definition of the nature and features of administrative procedures in prosecution authorities and identification of issues of administrative and legal regulation of such issues implementation. Theoretical generalization and new scientific task solution, which is to define the nature and features of administrative procedures in prosecution authorities of Ukraine and define the issues of their administrative and legal regulation based on the review of scholarly views and current statutory provisions and to develop, due to the positive local and foreign experience, the proposals and recommendations on improvement of the administrative legislation, provisions of which are defined by legal frameworks of implementation of the relevant procedures, have been shown in this thesis. The concept and meaning of administrative procedures in prosecution authorities have been defined. The principles of organization and implementation of administrative procedures in the prosecution authorities have been determined. The legal framework of organization and implementation of administrative procedures in prosecution authorities has been described. The administrative procedures in prosecution authorities have been classified. The nature of managerial decision-making and implementation procedures in prosecution bodies, as well as personnel procedures and procedures for bringing prosecutors to responsibility, have been revealed. The foreign experience of legal regulation of administrative procedures implementation in the prosecution bodies has been generalized and possibilities of its application in Ukraine have been developed. The areas for improvement of administrative legislation, provisions of which are defined by legal frameworks of administrative procedures implementation in the prosecution authorities, have been determined.
