The thesis is devoted to the comprehensive theoretical study of the legal frameworks for the use and protection of land for summer cottage construction. The scientific work carried out a historical and legal analysis of the formation and development of legislation regulating relations in the use and protection of land for summer cottage construction, and also investigated the object-subject composition and forms of land use for summer cottage construction. The concept of a land plot for summer cottage construction as a land plot intended for recreation of citizens, construction and operation of a country house for use during the year for temporary staying or permanent residence with the right to grow crops by citizens for their own consumption, has been defined. The legal forms of using land plots for summer cottage construction are characterized here in particular, individual and collective. It has been proved that the legal form of using a land plot for summer cottage construction is a legal model for the operation of a summer cottage provided by law, the basis of which is a certain legal title for this site that determines the specific features of the content of its legal regime. The dissertation provides a comprehensive analysis of the emergence and termination of rights to use land plots for summer cottage construction. The rights and obligations of subjects for the use of these land plots are disclosed, the essence of summer cottage construction as a process of creating real estate objects on a land plot is determined, designed to meet the needs of citizens in recreation. The scientific and theoretical analysis of the legal protection of lands used for summer cottage construction has been carried out.
