Kotelevski R. Criminal procedural guarantees of the realization of victim rights (both individual and legal person)

In this dissertation the issue of criminal procedural guarantees of the realization of victim rights (both individual and legal person) is analyzed on the basis of an exploration of the academic literature, analysis of international instruments, current legislation of Ukraine and use of it. Also the process of development of the concept of «victim» in criminal proceedings during the development of the Criminal procedure legislation of Ukraine is analyzed in this dissertation. The author concluded that «victim» and «claimant», as participants in the process at the pre-trial stage, in most cases have the same rights, in contrast to a trial stage. Realization of their rights is primarily focused on conscious citizenship which is aimed at protection and restoration of violated individual, social and public interests that indicates the unity of their legal nature.
