Essay

The thesis comprehensively studies public authorities’ control in the field of the exercise and protection of the rights and freedoms of persons with disabilities in Ukraine, in particular analyses the essence, the legal basis and specificities of the mechanism for public authorities’ control of the exercise and protection of the rights and freedoms of persons with disabilities. The study enables the applicant to make a number of original conclusions, suggestions and recommendations. The essence of the category "person with a disability" is improved, the concepts of control in the field of the exercise and protection of the rights and freedoms of persons with disabilities in Ukraine, of principles of control in the field of the exercise and protection of the rights and freedoms of persons with disabilities in Ukraine, of legal and regulatory framework for control in the field of the exercise and protection of the rights and freedoms of persons with disabilities in Ukraine are defined. Public authorities are considered as actors with powers to control the exercise and protection of the rights and freedoms of persons with disabilities and they are classified according to five criteria: by the scope of control powers; by status; by form of control; by type of participation in monitoring activities; by social sectors. Forms and methods of control in the field of the exercise and protection of the rights and freedoms of persons with disabilities in Ukraine are defined and analysed. Public authorities’ control of the exercise and protection of the rights and freedoms of persons with disabilities are analysed in public sectors such as social welfare, labour, education, health and access to social infrastructure. Drawbacks in the respective control in these sectors are identified. The study outlines the areas of improving control in the field of the exercise and protection of the rights and freedoms of persons with disabilities in Ukraine and proves the need to initiate a number of changes and amendments to the current legal and regulatory framework governing the control of the exercise and protection of the rights and freedoms of such persons.
