Demchyk N. Legal Institute of Compulsory Return and Expulsion of Foreigners and Stateless Persons by the State Border Guard Service of Ukraine

The dissertation is devoted to the research of the peculiarities of the legal regulation of forced return and expulsion of foreigners and stateless persons by the bodies of the State Border Guard Service of Ukraine. The doctrinal approaches of administrative law, the provisions of national and foreign legislation, the specifics of its implementation in relation to the legal regulation of combating illegal migration are systematically analyzed. The evolution of formation, organizational and legal bases and tendencies of development of powers of border service concerning application of administrative and compulsory measures in realization of migration policy are studied. A system of entities authorized to carry out forced return and forced expulsion of foreigners and stateless persons has been established. Linguistic and legal characterization of concepts to denote forced migration of a migrant is carried out. The powers and peculiarities of the administrative-procedural activity of the state border guard bodies regarding the forced return and forced expulsion of foreigners and stateless persons are considered. The international, border, national and local levels of interaction of the State Border Guard Service of Ukraine with other entities on forced return and expulsion are described.
