Sevostianova H. State regulation of public procurement in the context of European integration processes

The dissertation is devoted to substantiation of theoretical and scientific-methodical provisions and development of practical recommendations on state regulation of public procurement in the context of European integration processes. The research analyzes the current state and development of public procurement in Ukraine and the European Union, which is the basis for identifying problems of public procurement and justifying ways to solve them. The methodical approach to the analysis of the state and tendencies of development of public procurement system in Ukraine and the countries of the European Union is developed. The problems of public procurement in Ukraine are identified. The genesis of state regulation of public procurement in Ukraine and their adaptation to the requirements of European legislation was investigated. Legislative provision of public procurement in Ukraine with the identification of problems is systematized. A comparative analysis of approaches to the organization of public procurement in Ukraine and the European Union has been carried out, which is the basis for identifying areas of harmonization of public procurement with European standards. The specificity of public procurement as an object of state regulation is grounded. The relationship between the concepts of public procurement system has been substantiated. The concept of "public procurement" and "state regulation of public procurement" has been clarified. The mechanism of state regulation of public procurement has been proposed. The principles of public procurement have been systematized. The criteria for the effectiveness of public procurement have been substantiated. The classification of risks of public procurement has been improved through the introduction of new classification attributes: by stakeholders of public procurement; by legislative risks; by stages of public procurement, which is the basis for the development of a system of indicators of public procurement efficiency and identification of areas of public procurement reforms in context of European integration processes. The dependence of risks on the stage of public procurement was determined. Developed a methodical approach to justify the directions of state regulation of public procurement and risk-based efficiency assessment. Theoretical and methodological approach to assessing the effectiveness of public procurement has been designed. A model of dependence of expected cost on the share of non-competitive procedures, the dependence of the average percentage of savings on the share of non-competitive procedures; the dependence of the amount of savings on the share of unsuccessful procedures is built. A simulation model for assessing the potential effectiveness of ensuring the success of competitive procedures is built. The recommendations for improving the legislative support of public procurement in the context of European integration have been substantiated. The roadmap for the implementation of directions of state regulation of public procurement in the context of European integration processes is developed, that will increase the efficiency of procurement and competitive position of the national economy.
