The dissertation is devoted to the decision of a scientific problem of substantiation of theoretical, methodical and applied bases of legal regulation of working hours and rest time of scientific and pedagogical workers of establishments of higher education. The nature of working time and leisure time as an institution of labor law is revealed. The influence of the labor function of the scientific and pedagogical worker on the definition of working time and rest time is clarified. The working time and rest time of scientific and pedagogical workers as a measure of work are characterized. Modern problems of legal regulation of working hours of scientific and pedagogical workers and its accounting are revealed. The specifics of the work of scientific and pedagogical workers outside the normal working hours are determined. Ways to improve the legal regulation of working time of research and teaching staff and its accounting are substantiated. The legal guarantees of scientific and pedagogical workers for rest are generalized. The content and significance of vacations of scientific and pedagogical workers and the procedure for their granting are revealed. Proposals for improving the labor legislation of Ukraine are substantiated.
