Gebesh S. Initiation of proceedings in an administrative case as a stage of administrative proceedings

The dissertation research is devoted to the disclosure of the main theoretical provisions on the opening of proceedings in an administrative case as a stage of administrative proceedings and the formulation of proposals for improving the relevant legal regulation. The paper reveals the concepts and features, defines the principles, functions of administrative proceedings as a stage of administrative proceedings in Ukraine. Entities that can be participants in this stage of administrative proceedings have been identified. The appeal of citizens to the court with an administrative lawsuit as a ground for initiating proceedings in an administrative case is described. The order of actions of the judge during the decision of a question on opening of proceedings in administrative case is established, the characteristic of the decision on opening of proceedings in administrative case is given. Previously expressed proposals for improving the legislation on the researched issue are systematically presented and analyzed. Author's proposals for improving the legal regulation of administrative proceedings are formulated, taking into account foreign experience (based on the codes of administrative procedure or the laws of Austria, Lithuania, the Czech Republic, France).
