Essay

The thesis is devoted to the improvement of theoretical and practical aspects of administrative and legal support for the application of coercive measures by law enforcement agencies of Ukraine. In scientific research the relevance of the topic is substantiated in view of modern world globalization and transformation tendencies. The administrative-preventive aspect of police activity on application of preventive measures is analyzed. The genesis of administrative and legal support for the application of coercive measures by law enforcement agencies of Ukraine has been studied. Regulatory and legal support and legal grounds for the application of coercive measures by law enforcement agencies of Ukraine are analyzed. The normative legal acts concerning the establishment of the procedure for the application of one or another coercive measure are separated from the normative legal acts outlining the legal grounds for their application. The order of physical force use, special means and firearms is characterized. The algorithm and features of warning citizens about the intention to use physical force, special means and firearms are presented. Author's analytical materials on the warning that precedes the application of coercive measures are presented. The basic principles of application of coercive measures by law enforcement bodies of Ukraine are investigated. The algorithm of actions of authorized subjects to make a decision on the application of coercive measures is analyzed. Prohibitions on the use of coercive measures by law enforcement agencies of Ukraine are analyzed. Unified and systematized restrictions and prohibitions of general and special nature and their criteria, which are used to ensure the prevention of illegal and unjustified use of coercive measures.
