Essay

The thesis is devoted to a complex research of the theoretical and practical materials of administrative and legal regulation of inclusive education of Ukraine, taking into account the provisions of current domestic and foreign legislation researched and covered in this field, the concept, essence of objects and subjects of regulation in education for people with special educational needs. The emergence of a reversal of the public mentality in relation to people with special educational needs from rejection and the beginning of considerations of charity to a full partnership with them in the further development of society is argued. But there are still many unresolved issues along the way, including the administrative and legal regulation of education for people with special educational needs. The administrative and legal regulation of inclusive education in Ukraine through the prism of reforms which have been taking place in this area is revealed. It is stated that the improvement of current legislation by amending, supplementing, updating and systematizing are the backgrounds of the reform in the Ukrainian system of education in for people with special educational needs. The author’s concept of ‘education for people with special educational needs” and the administrative and legal status of the public administration, which regulates the education of people with disabilities in Ukraine, is revealed. The principle of action and interaction of subjects of educational inclusive activity in consideration of independence on any issues within their autonomy, regardless of the form of ownership and in accordance with the legislation and other regulations governing inclusive education is defined. The generalized results of the governmental reforms and the impact of the market economy on educational institutions in the Republic of Lithuania, which have passed the stages of reforming the education of persons with special educational needs from integrated to inclusive education of persons with special educational needs, are presented. A pilot model of the implementation of inclusive education at the institutions of higher education on the example of a single inclusive institution - the Open International University of Human Development “Ukraine”, which has undergone a full path of reform and implementation of inclusion is proposed. This model can serve as a stimulus for reforms in the implementation of inclusive education.
