Shevchuk O. Extrajudicial settlement of administrative disputes

The dissertation is one of the first in the national science of administrative law comprehensive research dealing with theoretical, methodological and applied problems of out-of-court settlement of administrative disputes, which is aimed at improving the current legislation taking into account the best foreign experience and general tendencies of reforming the justice system. The objective of the research is based on the analysis of current legislation, theoretical provisions of legal science, generalization of practice and foreign experience, development of theoretical and methodological and conceptual principles of out-of-court settlement of administrative disputes. The author of the study proposes the concept of separation of legal relations in the field of out-of-court settlement of administrative disputes as an independent internally organized category of administrative legal relations; the author's definition of non-mediatability of an administrative dispute is proposed; concluded that the signs of non-mediatability of an administrative dispute should be clearly indicated in the norms of the Code of Administrative Procedure of Ukraine and be complete; the category of the scope of discretion of the subject of power through the prism of the possibility of out-of-court settlement of administrative disputes is analyzed.
