Kapynos O. Theoretical and legal foundations of the functioning of administrative legal proceedings in Ukraine

The thesis presents a theoretical generalization and a new solution to the scientific problem, which consists in determining the theoretical and legal foundations of administrative legal proceedings with the subsequent formation of proposals for improving the relevant legislation. The content is revealed, the correlation of the structure and further development in the context of the formation of the rule of law is established, such basic institutions for legal science as “administrative process”, “administrative justice” and “administrative legal proceedings” are disputed from the side of their interpretation, the definition of which is defined as the procedural form of the activity of administrative courts for the consideration of public law disputes arising between citizens, other subjects of power relations and public authorities or their officials, regarding the legality of legal acts, decisions, actions (inaction) adopted by them, and the resolution of such disputes on the basis of ensuring the protection of human rights and freedoms, the legitimate interests of organizations through the use of judicial control and justice institutions.
