Ulozhenko V. Legal Bases of Public Administration of the Institutions of Higher Education in Ukraine

Thesis is the complex research of legal bases of public administration of institutions of higher education in Ukraine. On the basis of scientific works and legislation the essence and administrative legal status of a higher educational institution are revealed. It is proved that higher educational institutions play a system-forming role for higher educational system. The periodization of the higher educational institutions’ system and public administration of higher education in Ukraine has been defined according to significant changes in the legislation on education and higher education. The content of the concept of "public administration of higher educational institutions" has been determined. The classification of subjects of public administration of higher educational institutions according to their legal status has been formulated. It has been established that the general authorities of public administration of higher educational institutions are Cabinet of Ministers of Ukraine, the Ministry of Education and Science of Ukraine, branch state bodies, which sphere of management includes the institutions of higher education, the State Education Quality Service of Ukraine and the National Agency for Higher Education Quality Assurance, and the leading ones are the Ministry of Education and Science of Ukraine and the National Agency for Higher Education Quality Assurance. It has been proved that public administration of higher education institutions as an activity is carried out within the framework of the mechanism of public administration. Several elements of public administration of higher educational institutions are determined: authorities of public administration of higher educational institutions, object of public administration, means of public administration of higher educational institutions and legislation, providing an interaction between them. The basic means of public administration of public higher educational institutions are singled out: licensing of educational activities, accreditation of educational programs, state certification of scientific (scientific and technical) activities of higher educational institutions and state order for the training of specialists with a higher education. The order of their application to higher educational institutions is revealed. The features of public administration of higher educational institutions are clarified depending on the form of ownership. The legal bases of functioning of higher educational institutions as the state institutions, non-profit and profitable higher educational institutions have been analyzed. The experience of public administration of higher educational institutions of the Visegrad Group has been studied for the comparison and substantiation of proposals for solving the identified problems.
