Siryk V. Organizational and Legal Foundations of State Executive Authorities’ Participation in State-Owned Commercial Enterprises’ Governance

The dissertation examines the organizational and legal foundations of state executive authorities’ participation in state-owned commercial enterprises’ governance. In particular, in the dissertation according to the set tasks: the review of the special literature devoted to research of these questions is carried out; the essence of the organizational and legal foundations of state executive authorities’ participation in state-owned enterprises’ governance clarified; the concept of organizational and legal foundations of state executive authorities’ participation in state-owned commercial enterprises’ governance is defined; foreign experience of executive authorities’ participation in state-owned enterprises’ governance has been provided. State-owned commercial enterprise as object of governance have been investigated and its specific features determined. Legal regulation as the basis of effective organizational foundations of implementation of function as to of state executive authorities in governance of state-owned enterprises is reviewed. Organizational aspect revealed through function and executive authority institutions that perform function. Efficiency of implementation of function as to of state executive authorities in governance of state-owned enterprises was considered as criteria of proper performance. In the addition, the dissertation pays considerable attention to the ways of improving of the organizational and legal foundations of state executive authorities’ participation in state-owned enterprises’ governance. The conclusions and recommendations on participation of executive authorities in state-owned enterprises’ governance have been developed. Proposals for improving the organizational and legal framework for the participation of executive authorities in the management of state-owned commercial enterprises in Ukraine, including taking into account foreign experience
