Rikhter V. Public administration of judicial career in Ukraine

The dissertation, based on the analysis and study of conceptual ideas, scientific positions and regulations, reveals the public administration of judicial career in Ukraine, formed progressive and modern conclusions, proposals and substantiated provisions for improving current legislation and practice of public administration. The legal nature of the judicial career from the standpoint of administrative law of Ukraine is revealed. The modern peculiarities of the administrative and legal status of a judge in Ukraine are determined. The principles of public administration of judicial career as part of the general conceptual model of legal regulation of the judiciary, which are enshrined in law and international standards, and establish requirements, conditions, guarantees and tools of special judicial administration to ensure the functionality of the judiciary in professional and specialized protection of the rights, freedoms and legitimate interests of individuals in society. The public administration of the selection and appointment of judges in Ukraine has been determined. The public administration of ensuring the independence of judges is described, which establishes a system of legal requirements, prohibitions and guarantees on the legal status of judges in order to prevent any pressure on the judiciary, protect the rights, freedoms and legitimate interests of judges and ensure the rule of law. . The factors of formation of the administrative nature of disciplinary responsibility of judges are found out. Peculiarities of public administration of dismissal of judges in Ukraine are formed. The European experience of public administration of judicial career is analyzed. Directions for improving the public administration of the judicial career of a judge in Ukraine have been identified.
