Shchavynska Y. Public Administration of Property Rights Registration in Ukraine

The dissertation presents the solution of the scientific problem concerning the public administration of the registration of property rights in Ukraine. It is an important comprehensive study within the framework of administrative science, which reveals the administrative principles and tools of public administration of registration of property rights in Ukraine. Based on the results of the analysis, the scientific provisions and conclusions proposed personally by the applicant are formulated. The concept of public administration of registration of property rights in Ukraine as an administrative activity of public administration and judicial activity of commercial courts has been formed. The essence of public administration of property rights registration in Ukraine is clarified. The legal nature of property rights and their state registration are identified and described as inseparable legal factors, when the first component belongs to the field of private law as a kind of origin, existence and termination of property rights, and the second - administrative law, which establishes the rules of its public registration. The principles of public administration of registration of property rights as the main starting points and general and special basic provisions of the philosophy of law and the theory of administrative law have been identified and generalized. The legal nature of the administrative procedure for registration of property rights in Ukraine has been clarified. The peculiarities of administrative-legal and judicial protection of property rights in Ukraine are clarified. A comparative characterization of the successful European experience of public administration of property rights registration has been made. Public administration of property rights registration in Ukraine has been improved.
