Piskunova O. Administrative and legal bases of formation and implementation of state policy in the field of information protection

The dissertation is devoted to the definition of administrative and legal bases of formation and realization of the state policy in the field of information protection, and also to formulation of perspective directions of perfection of the administrative legislation in this part. The study presents a modern view of understanding the content and purpose of state policy in the field of information protection of Ukraine as an object of administrative and legal regulation. It was noted that the state policy in the field of information protection is a separate direction of the state policy ensuring national security, which is aimed primarily at ensuring the national interests and security objects of critical infrastructure. Secondly, the state policy in the field of information protection is aimed at the realization of the constitutional rights of individuals and legal entities regarding the circulation and use of information. The feature of the formation of the latteris is to formulate an instrumental and institutional component in such a way as to ensure a balance of public and private interests in the field of information protection. Ensuring a balance of interests in the information sphere is achieved through positive commitments, which are the main legal tools for information protection. There is outlined range of tasks, principles and main directions of formation and implementation of the state policy in the field of information protection of Ukraine. There was revealed content of the legal basis for the formation and implementation of state policy in the field of information protection of Ukraine. The formulated notion and identified structure of the administrative and legal mechanism for the implementation of state policy in the field of information protection of Ukraine. There is outlined system of subjects of realization of the state policy in the field of information protection of Ukraine. There are determined forms and methods of implementation of the state policy in the field of information protection of Ukraine. The have been clarified range and content of administrative procedures of the implementation of state policy in the field of information protection of Ukraine. The were formulated progressive ways of improving the administrative and legal mechanism of formation and implementation of state policy in the field of information protection in Ukraine. The reasonably scientific and theoretical conclusions and practical proposals aimed at improving the legislation, the rules of which regulate the instrumental and procedural component of the administrative and legal regulation of the mechanism of formation and implementation of state policy in the field of information protection.
