The dissertation is devoted to the analysis of the criminological principles of the activities of the units of counteracting drug-related crime of the National police of Ukraine, it formulates scientifically substantiated proposals for improving the legal regulation and organization of measures to suppress drug-related crime in the National police of Ukraine.
As a result of the study, for the first time, the definition of the concepts of anti-drug safety and the preventive activity of the units for combating drug-related crime of the National police of Ukraine was proposed, and the conditions for the effectiveness of preventing drug-related crime were determined.
Anti-drug security is defined as the state of protection of the individual, society and the state from criminally unlawful encroachments and other criminological threats associated with the illegal circulation of narcotic drugs, psychotropic substances, their analogues and precursors, as well as the consequences associated with these threats.
The preventive activities of the drug-related crime units of the National police of Ukraine are the activities of the units for combating drug-related crimes and other units of the criminal police (criminal investigation department, strategic investigations), which systematically, comprehensively carry out search, operational-search, administrative, criminal procedural and other preventive measures (actions) appointments aimed at individual groups and specific individuals who are prone to committing criminal offenses related to the illegal circulation of narcotic drugs, psychotropic substances, their analogues and precursors, and / or have criminally unlawful intentions to commit them or have started criminally illegal activities in order to minimize criminogenic factors and behavior correction of persons prone to committing these offenses, preventing the commission of criminal offenses at different stages of criminal activity, as well as minimizing drug addiction in the country.
The directions of optimization of legal regulation and organization of preventive activities of the units for combating drug crime of the National police of Ukraine are stated, the criteria for assessing the effectiveness of such activities are clarified, measures are outlined for the prevention of the units for counteracting drug crime of the National police of Ukraine to criminal offenses related to the illegal circulation of narcotic drugs, psychotropic substances, their analogues and as well as manifestations of drug addiction.
To improve the mechanism of legal regulation, precautionary measures of the units for combating drug-related crime have been proposed by the National police of Ukraine: 1) development and adoption of a normative legal act regulating the general principles of combating crime, should directly have a preventive value, as well as the Law of Ukraine «On the prevention of alcoholism, drug addiction and substance abuse»; 2) at the regional level, the adoption of comprehensive programs for the prevention of illicit circulation of narcotic drugs, psychotropic substances, their analogues and precursors. Programs should be aimed primarily at preventing the illegal sale of these funds and substances, taking into account the socio-demographic and economic development of the region; 3) development and adoption of a normative legal act of the Ministry of Internal Affairs of Ukraine, regulating the activities of the criminal police in general and its individual operational units for the prevention of criminal offenses; 4) development and adoption of a normative legal act of the National police of Ukraine regulating the structural and functional structure of the unit for combating drug crime, its main tasks and functions, the general foundations of the activities of this unit to counter drug crime, including preventing it; 5) provisions in the Instruction on the organization of interaction of pre-trial investigation bodies with other bodies and units of the National Police of Ukraine in the prevention of criminal offenses, their identification and investigation of the issue of interaction of pre-trial investigation bodies and operational units in the prevention of criminal offenses related to the illegal circulation of narcotic drugs, psychotropic substances, their analogues or precursors.
