Shchyruk M. Administrative and legal instruments for ensuring national security by law enforcement agencies

The Thesis is devoted to defining legal and administrative instruments to ensure national security by law enforcement agencies, as well as formulating promising directions of the development of administrative and legal regulation of the procedure for applying administrative and legal instruments in the area of ensuring national security by law enforcement agencies. The study presents a modern view on the interpretation of the content and purpose of the State policy in the sphere of ensuring national security by law enforcement agencies. It has been argued that State policy in the area of ensuring national security by law enforcement agencies is the set of actions and measures of the State (institutions, establishments, State authorities) aimed at the preparation and implementation of the latest and effective processes and techniques, the purpose of which is to protect the interests of the State, society and individuals in the defense, social, political, economic, informational, environmental spheres from internal and external threats. The concept and content of administrative instruments in the area of ensuring national security by law enforcement agencies has been formulated. The types of administrative and legal instruments in the sphere of ensuring national security by law enforcement agencies have been clarified. Law enforcement agencies have been considered from the standpoint of the actors of application of administrative tools in the area of ensuring national security and institutionalization of legal and administrative instruments in the area of ensuring national security. The procedure for the adoption of administrative acts in the sphere of ensuring national security by law enforcement agencies has been disclosed. The peculiarities and features of the application of administrative and legal measures performed by law enforcement agencies in order to ensure national security have been clarified. The essence, concepts and features of the procedures for the use of organizational tools in the area of ensuring national security by law enforcement agencies have been clarified. The European integration of Ukraine has been considered as the basis for establishing the institution of administrative and legal instruments in the sphere of ensuring national security by law enforcement agencies. The scientific and theoretical conclusions and practical proposals aimed at improving legislation, the rules of which govern the procedures for the application of administrative and legal instruments in the sphere of ensuring national security by law enforcement agencies, have been substantiated.
