Prianishnikova I. Administrative and legal principles of cooperation between the media and the National Police agencies at the introduction of the legal regime of martial law

The Thesis defines and reveals the content and essence of the administrative and legal principles of cooperation between the media and the National Police agencies at the introduction of the legal regime of martial law, which became the basis for identifying specific directions and ways of improving the procedure for its implementation. It has been found that the interaction of the media with the National Police agencies at the introduction of the legal regime of martial law can only occur in the direction of information management without media monitoring of police activities. Three groups of tasks for the interaction of mass media with the National Police agencies at the introduction of the legal regime of martial law have been allocated. It has been clarified that their implementation is performed in accordance with the established principles, the leading one among which is the principle of confidentiality. It has been emphasized that the only legal instrument that defines in detail the procedure for interaction between the media and the defense forces, including with the National Police at the introduction of the legal regime of martial law, is the Order of the Commander-in-Chief of the Armed Forces of Ukraine «On the Organization of Interaction between the Armed Forces of Ukraine, other members of the defense forces and representatives of the media during the legal regime of martial law». It has been revealed that the interaction of the media with the National Police agencies at certain restrictive measures of the legal regime of martial law involves both impersonal interaction between these actors (the use of National Police materials, subject to official publication on its information portals), and their direct cooperation through carrying out joint patrols in compliance with the rules of martial law. The directions of improvement of administrative legislation in terms of improving the process of interaction of the media with the National Police agencies at the introduction of the legal regime of martial law have been determined, in particular: 1) development and adoption of the Procedure for the interaction of the media with State authorities in a special period, in a state of war or emergency; 2) development and approval of the procedure for the interaction of the National Police agencies with the media at the introduction of the legal regime of martial law; 3) unification of the rules of work of journalists at the introduction of the legal regime of martial law; 4) amending Article 22 of the Law of Ukraine «On Information»; 5) amending Appendix 3 of the Order of the Commander-in-Chief of the Armed Forces of Ukraine dated March 3, 2022 No. 73; 6) development of an algorithm for permanent communication of National Police employees with the media by operating a «hotline»; 7) introduction of a procedure for joint communication skills training of press officers and mass media representatives.
