Shulha O. Protection of the right to a healthy environment in administrative proceedings

The dissertation conducted a comprehensive scientific study of the essence of administrative disputes in the field of protection of the human right to a healthy environment, identified problematic aspects of their settlement, formulated proposals for improving the current legislation in this area and the practice of its application. It is determined that the subject composition of legal relations related to ensuring the implementation and protection of the right to a healthy environment is characterized by the presence of a special circle of persons (public associations and organizations, charitable organizations) authorized to initiate court proceedings to protect public environmental interest, the implementation of which is connected not only with guaranteeing the right of a person to a safe environment, but also with the right to a favorable environment, including the right of a person to a favorable one anthropogenic environment.
