Essay

The dissertation is devoted to the study of theoretical and practical problems of administrative and legal regulation of the activity of regional service centers MIA of Ukraine in the field of public service provision. The concept of the activity of the RSC of the MIA in the field of public service provision is defined as a mechanism for the implementation of the public service function of these bodies regulated by the norms of administrative law, aimed at creating conditions for the realization of the rights and legitimate interests of individuals and legal entities, by providing paid and free of charge public service services. The regulatory legal acts that form the legal basis of the activity of the RSC of the MIA in the field of public service provision have been analyzed. The structure of the administrative and legal status of the RSC of the MIA is characterized, which is presented in the form of a three-component model. The purpose of the target component of the administrative-legal status of the RSC of the MIA has been clarified, which allows to identify the degree and vectors of managerial influence of these bodies on administrative legal relations in the field of public service provision. The priority areas of interaction of the RSC of the MIA with other entities providing public services have been determined: a) interaction in the field of registration and licensing procedures; b) interaction in the field of organizing activities for the transportation of passengers and cargo by road transport; c) interaction in the field of wholesale and retail trade in motor vehicles; d) educational and professional interaction with institutions of higher education of the MIA. Based on the analysis of Directives 1999/37/EU, 2006/126/EU and 2009/40/EU, directions for improving the legal support for the activities of the RSC of the MIA in the field of providing public services have been determined, including the need to establish in the norms of national legislation requirements for : model and categories of driver's license; the minimum age for driving vehicles; qualifications of examiners involved in taking examinations for the right to drive vehicles, establishing a simplified procedure for registration (re-registration) of vehicles, etc. A project of the Model Regulations on the regional service center of the MIA has been developed. It is proposed to make appropriate changes and additions to other normative legal acts that constitute the legal basis for the activities of the RSC of the MIA.
