Melnyk V. Administrative and legal provision of state supervision (control) over compliance and fulfillment of the requirements of legislation in the field of fire safety

It also reveals the essence and content of fire safety as an object of state supervision (control). The concept and peculiarities of state supervision (control) over the observance and implementation of the requirements of legislation in the field of fire safety have been defined. It has been found that the state supervision (control) of compliance with the requirements of the legislation in the field of fire safety is an activity regulated by the norms of the current legislation, which is aimed at detecting and preventing offenses in the field under investigation, as well as at assessing the state of compliance with special norms, rules and requirements, which are fixed in the current legislation of Ukraine. It has been emphasized that, taking into account the specifics of the studied area, state supervision should be carried out constantly and cover all aspects related to fire safety. The types of state supervision (control) over compliance and fulfillment of the requirements of legislation in the field of fire safety have been outlined. A description of the legal principles of state supervision (control) of compliance and implementation of the requirements of legislation in the field of fire safety is given, and the place of administrative and legal norms among them has been established. The tasks and functions of state supervision (control) over compliance and fulfillment of the requirements of legislation in the field of fire safety have been clarified. The subject and limits of state supervision (control) over compliance and fulfillment of the requirements of the law in the field of fire safety has been established. The system of subjects of state supervision (control) over the observance and fulfillment of the requirements of the legislation in the field of fire safety is outlined and the characteristics of their powers has been provided. Attention has been focused on the fact that today in Ukraine, a fairly extensive system of subjects of state supervision (control) has been built for the observance and fulfillment of the requirements of the legislation in the field of fire safety, each of which performs its own powers characteristic only for them. At the same time, the fact that the legislator in the vast majority of cases does not separate supervisory (control) powers in the field of fire safety from other aspects of civil protection has been noted as a drawback. The author has proposed to understand administrative and legal methods of state supervision (control) over compliance with and implementation of the requirements of legislation in the field of fire safety as a set of instruments, methods, techniques and means defined by administrative law and used by specially authorized entities for the purpose of effective control and supervision in the relevant area. Attention has been drawn to the fact that the study of foreign experience in the implementation of state supervision (control) of compliance and implementation of the requirements of legislation in the field of fire safety is very important from the point of view of ensuring the general safety of the population and reducing the risks of fire occurrence. The thesis has been identified promising areas for improvement of administrative legislation regulating the exercise of state supervision (control) over compliance with and fulfilment of the requirements of legislation in the field of fire safety. The author has identified the ways to improve administrative procedures for exercising state supervision (control) over compliance with and fulfilment of the requirements of legislation in the field of fire safety.
