The thesis reveals the categorical and conceptual definition, content, and essence of the administrative and legal mechanism for interaction of security and defence sector entities with regard to ensuring national security, as well as the determination of its features in a systemic and comprehensive manner. The administrative and legal mechanism for interaction of security and defence sector entities with regard to ensuring national security is defined as a totality of administrative and legal means that objectify a set of regulatory, organisational, control and supervisory actions implemented by the national security entities with the purpose of ensuring appropriate conditions (fundamentals), principles, rules, standards and procedures for the functioning of the process of implementation of interrelations between the security and defence sector entities of Ukraine in the course of performing their functional duties. It is specified that the administrative and legal means which form the structure of the administrative and legal mechanism for interaction of security and defence sector entities with regard to ensuring national security can be considered in two aspects: as a set of administrative and legal provisions or as instruments for implementing administrative decisions. It is proved that the latter approach is used in the general definition of the concept of the administrative and legal mechanism (the emphasis is placed on its instrumental component), since administrative and legal means reflect its most significant features.
It is determined that the purpose of the administrative and legal mechanism for interaction of security and defence sector entities with regard to ensuring national security is dual. The author hypothesises that the main general task of the administrative and legal mechanism for interaction of security and defence sector entities with regard to ensuring national security is to implement certain areas of public policy on national security and defence. It is clarified that the specific tasks of this mechanism directly depend on the tasks assigned to the entities that are to interact. They are determined individually and relate to the areas and types of joint activities that need to be regulated (for example, to regulate the procedure for delegating some full powers of a security and defence sector entity to another entity of this system for the purpose of efficient performance of the tasks of the national security system of Ukraine). It is proved that the administrative and legal mechanism for interaction of security and defence sector entities with regard to ensuring national security performs a number of functions. Such functions are conditionally grouped by common characteristics. The first group includes basic functions (regulatory and coordination functions). The second group includes targeted functions (institutional; control and supervision; support functions, etc.). The third group includes special functions (stabilisation, adaptation and prognostic functions).
It is stated that the structure of the administrative and legal mechanism for interaction of security and defence sector entities with regard to ensuring national security is as follows:1) Administrative and legal provisions objectified within the regulatory framework consisting of regulations of different legal force, of general and special orientation, the main purpose thereof is to regulate a specific issue within the relations under study; 2) Objects being regulated – the activities and conduct of security and defence sector entities; 3) Regulatory actors – that is, those actors that form the legal framework and procedures for the interaction under study (both hierarchically higher level entities and the actors of interaction themselves); 4) Administrative legal relations that arise between objects being regulated and regulatory actors, as well as those that arise, develop and terminate between representatives of the security and defence sector (these are both horizontal and vertical relations characterised by different content); 5) Administrative and legal means of implementing the administrative and legal mechanism for interaction of security and defence sector entities with regard to ensuring national security: rule-making (establishment of rules, procedures, duties, etc.), organisational (collection of information, preparation of documents, etc.), support (methodological support, technical and material equipment, financing, etc.) and managerial (encouragement, persuasion, control and supervision, etc.).
